1. Acceptance of Terms

By downloading, installing, or using the Paintball Team-Up application or website (the "Service") operated by JoinUp LLC ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and revising the effective date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

• You are at least 13 years of age.
• You have the legal capacity to enter into these Terms.
• You will comply with all applicable laws and regulations.
• You have not been previously suspended or removed from the Service.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorised use of your account at info@paintballteamup.com.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Harass, abuse, threaten, or harm other users.
• Post false, misleading, or fraudulent information.
• Impersonate any person or entity.
• Distribute spam, unsolicited messages, or advertising.
• Upload or transmit viruses or other malicious code.
• Attempt to gain unauthorised access to any part of the Service or its systems.
• Scrape, crawl, or use automated tools to extract data from the Service without authorisation.
• Interfere with or disrupting the integrity or performance of the Service.

5. User-Generated Content

You may post content including profile information, game listings, team descriptions, and messages ("User Content"). By posting User Content, you grant JoinUp LLC a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. You represent and warrant that your User Content does not infringe any third-party rights and complies with these Terms.

We reserve the right to remove any User Content that violates these Terms or that we deem objectionable, without prior notice.

6. Platform Role and No Supervision

Paintball Team-Up is a technology platform only that enables users to connect and organise recreational activities. JoinUp LLC does not:

• Organise, host, or supervise events.
• Provide equipment or venues.
• Verify the safety, legality, or conduct of participants.
• Control user behaviour or the actions of third parties.

All events are organised solely by users or third parties.

6A. Express Assumption of Risk

You acknowledge that paintball is an inherently dangerous activity involving risks including serious injury, disability, or death. You voluntarily assume all risks, known or unknown, associated with participation in any activities arranged through the Service.

6B. Release of Liability and Waiver of Claims

To the maximum extent permitted by law, you release and discharge JoinUp LLC and its affiliates from any and all claims arising from personal injury or death, property damage, or any activity arranged through the Service. This release includes claims arising from the actions of other users, venues, and third parties.

6C. Indemnification

You agree to indemnify and hold harmless JoinUp LLC and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your participation in activities arranged through the Service, your conduct, or your violation of these Terms.

6D. Medical and Fitness Acknowledgement

You represent that you are physically able to participate in any activities you arrange through the Service, and you assume sole responsibility for any medical costs or emergencies arising from your participation.

6E. No Insurance and No Duty of Care

JoinUp LLC does not provide any form of insurance coverage and assumes no duty of care with respect to activities organised through the Service.

6F. Minors

Users under the age of majority in their jurisdiction must obtain parental or guardian consent before using the Service. By permitting a minor to use the Service, the parent or guardian agrees to be bound by these Terms on the minor's behalf.

6G. Legal Limitations

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including in cases of gross negligence, fraud, or statutory consumer rights.

7. Intellectual Property

The Service and its original content, features, and functionality (excluding User Content) are and remain the exclusive property of JoinUp LLC and its licensors. Our trademarks, logos, and service marks may not be used in connection with any product or service without prior written consent.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination (including ownership, disclaimers, indemnity, and limitations of liability) shall survive.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JOINUP LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THIS LIMITATION INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE RELATED TO ACTIVITIES ORGANISED THROUGH THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED US DOLLARS ($100 USD) OR THE TOTAL AMOUNT PAID BY YOU TO JOINUP LLC IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming.

If you are located in Canada, you may have additional rights or remedies available to you under applicable provincial or territorial law, which are not affected by these Terms.
